What is Section 316 of Crimes Act 1961?
Any person who is arrested must be informed at time off arrest for reason of the arrest. UNLESS reason is obvious OR it is impracticable to do so.

FIND -someone disturbing the public peace.
OR
Committing any offence punishable by imprisonment.

Arresting someone under Summary Offences Act 1981 Section 39(1) states.
HAVE good cause to suspect…
Of having committed an offence against this Act.
EXCEPT sections 17-20, 25 and 32-38.
Arresting someone under Summary Offences Act 1981 Section 39(2)states.
HAVE within their view…
Does an act the constable believes is an offence against sections 17-20, 25 and 32-38.
**AND fails to give name and addy or gives false details. Arrest for the offence is seen being committed.
