What is a PSO?
An order issued by a Constable to a BOUND PERSON to ensure the PROTECTION of the PAR
Who can issue a PSO?
Any Constable if AUTHORISED by a SGT or above
4 options available to Police when attending a FV incident-1/4
1) NO FURTHER ACTION REQUIRED (K3). Consider advising about PO or REFERRAL to VS,WR or other relevant agencies
4 options available to Police when attending a FV incident-2/4
2) WARNING (K4) after review of file by FV, C/O consider ENCOURAGING AGGRESSOR SEEK HELP
4 options available to Police when attending a FV incident-3/4
3) ISSUE a PSO when insufficient to make K9 but you BELIEVE it is NECESSARY to ENSURE SAFETY
4 options available to Police when attending a FV incident-4/4
4)ARREST if offence disclosed and sufficient evidence exists
How long a Constable intending to issue a PSO against a person or detain that person for?
2hrs either at the address found or transport to the Police station
If PSO issued what MUST the BOUND PERSON surrender?
Any weapon/firearms in possession/under his control
What else MUST the BOUND PERSON do?
VACATE any land occupied by the person at risk regardless who owns it
You MUST explain 4 things to the BOUND PERSON (BP) and PERDON AT RISK (PAR)…
PURPOSE of the order, EFFECT of the order, DURATION of the order, CONSEQUENCES of breaching PSO
Within what timeframe should a PSO be served?
48hrs otherwise it becomes invalid
What happens to a PSO if it is not served within the 48hr timeframe?
It lapses
What is the duration of a PSO?
For a period specified in the order but no longer than 5 days
What other conditions are contained in the PSO?
NO; PHYSICAL or SEXUAL abuse (threats), DAMAGE or THREATEN to PROPERTY, psychological abuse, ENCOURAGE ANY PERSON to behave in the above, WATCH/LOITER/NEAR or prevent/hinder access to or from wherever the PAR lives or works, FOLLOW/STOP/ACCOST the person at risk in any place, ENTER/REMAIN where PAR is present, CONTACT PAR in any form unless for emergencies
What effect does a PSO have on a Parenting Order issued by the court?
Bound person that is party to a parenting order/agreement has no right to see their children once the PSD is in effect
