S.1, S.2: Stop and search procedure
Only a constable may search an arrested person.
To search an arrested person you must have think that the arrested person has the following:
- They might use to assist him to escape from lawful custody
- Which might be evidence relating to an offence.
The powers conferred by this section to search a person are not to be constructed as authorising a constable to require a person to remove any of his clothing in public other than an outer coat, jacket or gloves. If the police want to search someone’s mouth then the police officer must have authorised permission to.
A constable may not search a person in the exercise of the power conferred by subsections 2a above unless he has reasonable grounds for believing that there is evidence for which a search is permitted under that paragraph on the premises
A constable searching a person in the exercise of the power conferred by subsection 1 above may seize and retain anything he finds, if he has reasonable grounds for believing that the person searched might use it to cause physical injury to himself or to any other person.
A constable does not have permission to search things like vehicles without authorisation
The officer that has stopped you must only search the outside of your clothing.
There must be a reason to be arrested, if someone was to be arrested a police officer must have a reason to arrest someone.
In the mock there are physical evidence of them committing the crime meaning that the police where right for the arrest
