Once an examiner is satisfied that the statutory and Patent Office requirements have been satisfied, the applicant is sent a Notice of Allowance, which sets a 3 month period for payment of Issue Fee.

The 3-mo period cannot be extended but the Issue Fee can be accepted late Rule 1.137 if the failure to pay timely was unintentional.
