A patient is being nursed on level 1B observations at the start of the night shift, due to risk of harm to self.
However, the nurse in charge feels that the risk is no longer present but there are no doctors available. Can the nurse in charge make the decision to decrease the patients level of observations to level 2:15?

A patient is detained in hospital under section 3 of the MHA and has utilised section 17 home for their allocated 3 hours. However, they have locked themselves in their house and are refusing to return to the Bradgate unit.
Can the police return them to the unit under section 136 of the MHA?
What process must be followed?
The police can’t get the patient under section 136 as they are in the house and not a public place.
They would need a section 135 to remove the patient from their own home.
Where they can continue treatment under section 3 of the MHA.
A patient is detained in hospital under section 3 of the MHA and is due their depot injection. However, they state that they are not unwell and that they do not need the injection.
Can the patient refuse their depot injection?
The patient cannot refuse their depot injection.
If it is after the first three moths then the approval of a second opinion approved doctor must be obtained.
A patient is admitted under section 2 on the MHA, after two weeks in hospital the patient is saying that he would rather be nursed in the community and would comply with their CPN administering their depot injection fortnightly.
Could the patient be discharged on a CTO?
The patient has to appeal to the managers or tribunal within the first 14 days of retention.
The patient can’t be released as its past 2 weeks.
