Urgent Duty
Duty that has become pressing or demanding prompt action
Built-Up Area
- Buildings not over 100m apart on land next to road
- Street lights not over 100m apart
For at least 500m or if length of road is shorter, the whole road
Pursuit
An attempt by a police officer in a motor vehicle to stop and apprehend the occupant(s) of a moving vehicle, regardless of speed or distance, when the driver of the other vehicle is attempting to avoid apprehension or appears to be ignoring police attempts to stop them. A pursuit commences at the time you decide to pursue a vehicle that has ignored a direction to stop.
Continuation of a Pursuit
A pursuit is deemed to continue if you follow the offending vehicle or continue to remain in contact with the offending vehicle, whether or not your police vehicle is displaying warnings lights or sounding a siren.
Definition: Road
- An area open to or used by the public and is developed for or has one of its main uses the driving or riding of motor vehicles.

A vehicle that is built to be propelled by a motor that forms part of the vehicle
Definition: Road Related Area
- An area that divides a road,
- A footpath or nature strip adjacent to a road.
- An area that is open to or used by the public for the driving, riding or parking of motor vehicles
- A shoulder of a road
- Any other area that has been declared under s.18 RTA 2013 to be an area to which specified provisions under the act or statutory rules apply.
Prescribed HEAVEY MOTOR Vehicle
A motor vehicle with a GVM greater than 12 tonnes
Exemptions to wearing a seatbelt
- Driver is reversing the vehicle
- Person is a passenger on a public bus
- Person is in possession of a signed and dated medical certificate from a doctor, with an expiry date. Only valid from 12 months of issue.
- Person is passenger and the seating position is not fitted with one and there is no requirement for that position to be fitted with a seat belt.
- Two-up driver using sleeper compartment
- Door-to-door delivery person or waste collection, not travelling over 25km/h.
- Person is providing/receiving urgent/necessary medical treatment
Lawful U-Turns
- Driver making u-turn gives way to all pedestrians and vehicles
- Intersection with TCL with ‘u-turn permitted’ sign
- Intersection without TCL and NO ‘no u-turn’ sign
- Section of road with NO ‘no u-turn’ sign
- Road with dividing line/median from marked nearest lane to line or median from road they are turning.
- From the left of the centre of the road.
Un-lawful U-Turns
- Driver does not have clear view of on coming traffic and cannot safely make u-turn without obstructing traffic.
- Length of road with ‘no u-turn’ sign present
- At TCL with NO ‘u-turn permitted’ sign
- Intersection with ‘no right turn’ sign
- Driver does not give way to all vehicles and pedestrians
- Intersection with ‘no turns’ sign displayed
When police cannot breath test a person
- At person’s home address
- Outside of 2 hour time limit from incident
- Person conveyed to hospital for medical treatment and treating Dr says no
- It appears administering breath test would be dangerous to the person’s health due to injuries sustained
When police cannot take blood after a crash
- If medical practitioner, registered nurse or sample taker objects on grounds it would be dangerous to the person’s health.
- It appears to police, due to injuries, taking sample would be dangerous to person’s health.
- Outside of 4 hour time limit from crash.
PCA Ranges
- Novice: 0.000 - 0.019
- Special: 0.020 - 0.049
- Low: 0.050 - 0.079
- Mid: 0.080 - 0.149
- High: 0.150 and above
Registration Exemptions
- Vehicle under tow of tow truck operating as tow truck.
- Agricultural implement towed by another vehicle or trailer towed by agricultural machine.
- Being driven across road/related area to or from land used solely for the purpose of primary production.
- Golf/Green keeping vehicle being driven across a road/related area intersecting or traversing with golf course, being used for game of gold or course maintenance.
- Vehicle temporarily in NSW registered in another state/territory/country.
- Unregistered and has interstate permit/traders plate.
- Exempt under Interstate RTA 1985, engaged in the carriage of passengers/goods between prescribed places.
- Trailer towed by VIC registered vehicle, not used in the course of trade, weighs less tan 200kg unladen, manufactured width does not exceed vehicle width, not exceeding 3m length including draw bar and load.
- Vehicles used to fight rural fires.
- Lawn mowers no more than 250kg unladen constructed for grass cutting only.
- Pedal assisted cycle not exceeding 500 watts.
- Constructed for the purpose of conveying person with substantial physical disability. Not capable of travelling over 10km/h.
- Plates affixed, for registration purpose / inspection / testing.
Unlicenced driver exemptions
- Interstate/International VISITING driver with current interstate/international licence.
- Vehicle/Trailer not more than 250kg unladen for grass cutting.
- Person being submitted to a driving test by a police, or authorised officer.
- Golf/Green keeping vehicle being driven on road/related area intersecting/traversing with golf course, for game of golf or course maintenance.
- Vehicle for conveying physically disabled, not travelling more than 10km/h.
- Driver of light rail vehicle.
- Pedal assisted cycle, not more than 500 watts.

Travelling in bicycle lane

Driver

Prohibiting Driving
If police believe person under the influence of drugs or alcohol is about to drive:

Heavy Vehicle Signs

Parking signs

- Loading Zone = Picking up/setting down goods, not more than 30 mins unless sign permits

Sanctionable Offences
- Over 45 km/h
- Refuse blood sample/breath analysis (if convicted of alcohol-related major offence in last 5 years).

- Street race/speed record or trial on a road.
- Aggravated burnout.

Number plates
Must be permanently fixed to the vehicle so that (on level ground):
- Is in an upright position, substantially parallel to the vehicle’s axles.
- Not more than 1.3 metres above the ground.
- Is not obscured/defaced/illegible.
- Visible from any point front or rear: 20 metres away, and 45 degrees from either side, and 45 degrees from above.
- If a motorcycle or trailer, one plate attached to the rear.
- Any other type of motor vehicle, there is one plate to the front and rear.
- Any cover is clear and not tinted and has no characteristics that would interfere with the operation of traffic offence detection devices (speed cameras).
- If the plates are of two different sizes, the larger plate is fixed to the rear.
Minimum distance Between Long Vehicles
- Must keep 200 metres behind another long vehicle (for a road train).
- Must keep 60 metres behind another long vehicle (any other long vehicle).
- Unless:
o Driving on a multi-lane road, or
o In a built-up area, or
o Overtaking.
Heavy Vehicle Diary
Must have diary for previous 28 days, for trips outside of 100km radius of home base,
Races, attempts on speed records and other speed trials (RTA 2013, s. 115)
A person must not organise, promote or take part in, on a road:
- any race between vehicles
- any attempt to break any vehicle speed record
- any trial of the speed of a vehicle
- any competitive trial designed to test the skill of any vehicle driver or the reliability or mechanical condition of any vehicle
Unless the written approval of the Commissioner of Police has been obtained.
Towing another MV.
Person in charge of towed vehicle must hold a licence to drive the class of vehicle being towed.
Seizing Monitoring devices
Police may seize and retain any monitoring device or records from an applicable motor vehicle if the officer believes the device has been improperly interfered with.
Heavy Vehicles with a body less than 300mm at rear
Must have white or silver band painted on the rear of the tray when the vehicle is at least 2.2m wide
Power to Demand Licence

Towing vehicle parked contrary to signs
As per Police Handbook, police can tow vehicles in:
- Transit lanes
- length of road which clear way sign applies
- Bus Lanes
- T-way Lanes
Notify VKG to contact TMC to get Transport NSW to have vehicle moved.
Error in MobiPol Tickets
Within 72 Hours:
- If not submitted or complete, can be deleted. Reason must be entered and verified by supervisor
Outside of 72 Hours:
- Submit a report to supervisor outlining the circumstances and reason for error.
- Once supported, notify DTI and revenue NSW with report
Termination of Pursuit
All vehicles to cease to pursue, stop following and return to the legal speed limit. Turn off all warning devices as soon as possible and when safe.
