What is an Immediate Relative?
A spouse, parent, or unmarried minor child of a citizen.
When will a visa become available for an Immediate Relative?
They do not have to wait for a visa number because immediate relatives are not subject to the immigrant visa limit.
When is a PETITION considered properly filed?
When it is fully completed and signed, and the fee is paid.
If married less than two years, your alien spouse may be granted:
Conditional Permanent Resident Status.
What if your spouse is granted Conditional Permanent Resident Status?
File Form I-751, Joint Petition to Remove Conditional Basis of Alien’s Permanent Resident Status MUST be filed within the 90 day period immediately before the second anniversary of the date your alien spouse was granted conditional permanent resident status ( Form I-751)
What if you don’t file form I-751?
Your spouse’s permanent status will be revoked.
When is Form I-130 considered properly filed?
If it is signed, has the correct fee, and IT IS ACCEPTED BY THE USCIS.
What happens once the petition is accepted?
It is checked for completeness, including submission of the required initial evidence. If either one of those is missing, you will not establish a basis for eligibility and your petition may be denied.
How can you talk to an appointment at a local USCIS office?
Use the internet based system INFOPASS on the USCIS website. This generates an electronic appointment notice that appears on the screen.
