What is judicial proceedings for perjury?
Any court, tribunal or person having by law power to hear, receive and examine on oath
What is perjury?
Any person sworn as a witness or an interpreter in any judicial proceedings who WILFULLY makes a statement which he KNOWS TO BE FALSE OR DOES NOT BELIEVE TO BE TRUE.
What if statement is not make direct in front of judicial proceeding?
Still perjury if made to person authorised to record it and place it in front of such proceedings ie soe made to police officer
Where geographically does it extend
A statement made by a person lawfully sworn in NI for purpose of hearing
a) in any other part of her majesty’s dominions
b) in a British tribunal lawfully constituted in any place by sea or land outside her majesty’s dominions
c) in a tribunal of any foreign state
Shall be treated as making a statement in a judicial proceeding in NI
Does the statement have to be material to the case?
Yes. It must be “material in that proceeding”
Do you need corroboration for perjury?
Yes. In order to prove statement was false- not to prove statement was made
