What is the definition of “minor modification”? (Section 245.1)
Note: The term “substantial modification” used in Act 32 should not be confused with the terms “major modification” and “minor modification” used here. Act 32 defines any activity that changes the physical construction of the storage tank system as a substantial modification. Chapter 245 goes on to divide “substantial modifications” into “major modifications,” “minor modifications” and “maintenance.” “Major modifications” consist of changes to the buried portion of a storage tank system, such as the tank and piping. “Minor modifications” consist of changes to the exposed portion of a storage tank system, such as the line leak detector on the pump or shear valves or check valves under dispensers. “Maintenance” consists of routine activities, such as the replacement of filters, hoses and nozzles. The following table indicates who may perform each of these activities and which activities must also be inspected by a certified inspector.
Which lubricating and operational fluids would be included under the term “motor oil”? (Section 245.1)
The term includes lubricating and operational fluids for the mechanical components associated with the engine, including any hydraulic, transmission, gear or braking systems.
Which activities do the terms “removal” and “removal from service” include? (Section 245.1)
a) Removal — Activities involving removal of storage tank system components, ancillary equipment and appurtenances. The term includes removal from service activities when a storage tank or storage tank system is removed, but excludes site assessment activities.
b) Removal from service—The term includes the following:
(i) Activities related to rendering a storage tank system permanently unserviceable. Activities include the oversight of the proper draining and cleaning of the storage tank system of product liquids, vapors, accumulated sludges or solids, and completing one of the following:
(A) Leaving the storage tank system in the ground and filling the tank with inert, solid material.
(B) Dismantling or removing the storage tank system from the tank site.
(ii) Closure-in-place and permanent closure.
(iii) Site assessment activities required under Subchapter E (relating to technical standards for underground storage tanks) and applicable State law, which are the responsibility of owners and operators, but are not conducted by certified installers or inspectors.
How do the rules define “tank handling activities”? Is performing maintenance a tank handling activity? (Section 245.1)
Activities to install, modify, perform change-in-service or close all or part of a storage tank system or storage tank facility. The term does not include maintenance activities.

3) Submit a report of an inspection activity to the Department within 60 days of conducting an inspection activity, except for reports of modification inspection activities, which must be reported to the Department within 30 days of conducting a modification inspection activity. For inspection activities involving multiple certified individuals and certification categories, reports of modification inspection activities must be submitted within 30 days of the completion of all project tank handling and inspection activities.
