Patient Rights and Legal Issue: 5 Flashcards
Define self-determinism and its implications in mental health care
Allowing the patient to make their own decisions if they are able (self-determinism)
Autonomy: Right of self-determination and freedom of decision-making.
Patients have the right to refuse treatment unless immediate intervention is required
**Select all that apply that are examples of autonomy:
tell the patient the risks to the medication -and let them decide if they want to take it
ask the patient if they want to do **
Delineate the differences between voluntary and involuntary treatment
What criteria do u need to meet to get involuntary care?
Voluntary: Willingly seeks and agrees to services
Involuntary: Unable or unwilling to provide informed consent for mental health care
Just having psychosis does not make you a candidate for hospitalization. You need to be experiencing something really severe to meet involuntary care
-Suicidal
-Not eating
-Not bathing
-Aren’t taking care of themselves
What are examples that someone will need to be involuntarily treated?
-If they can’t take care of basic needs
-they are suicidal
-Person is not eating
Define confidentiality and mandates to inform (2)
When can u break confidentiality?
Keep information between patient/nurse (HIPPA)
Break confidentiality for Duty to Warn: If the patient states they will harm someone.
When should you break confidentiality?
person says they are going to kill their boss the minute they walk out of the hospital
Identify methods of intervention in accordance with patients’ rights (least restrictive)
-To detain patients who are at risk from themselves
-Patients are able to refuse restraints
-Should be administered last. Allow for other options first:
1. Decrease stimulus in room
2. Calm patient
**The patient feels their rights were taken away when they put on restraints on them immediately after being aggressive. What right are they talking about? Right to be free from unnecessary restraints.
