Technical specification is the standard
“document, established by consensus and approved by a
recognized body, that provides, for common and repeated use,
rules, guidelines or characteristics for activities or their results,
aimed at the achievement of the optimum degree of order in a given
context”
Why are standards needed?
- compatibility and interoperability of products
- Positive impact on trade
BUT - possible stifle of competition and discouragement of invention
De Jure Standard
Set by standard setting organisations and/ or statutory regulation
De Facto Standard
Implemented by market players and accepted by the public
When do standards become essential?
- When technology cannot be implemented without the standard
- When a patent disclosed that an invention is technically needed to implement a given industry standard

Inherent issues of patented technologies in standards
- competititve advantage for patent holder
- royalties
- bad scenarios
Standards are intended for colletive use - WIDE ADOPTION is necessary
Patents are all about exclusivity and creating a monopoly

FRAND
- fair terms (not anti-competitive)
- reasonable licensing rates
- non-discriminatory (both the terms
