Accomplice
Accomplice liability isn’t an offense, but a theory linking an accomplice to someone else’s crime. They are charged AS A PRINCIPAL.
Rule: DFT liable as an accomplice if they do some ACT (or omission, w duty to act) that FACILITATES principal’s commission or attempt, including encouragement w purpose to bring about
Modern MINORITY rule: provider of goods/services is accomplice if they know they are assisting a criminal and they benefit
Accomplice liability - scope
Accomplices are liable for purposefully facilitated crimes, AND any that are objectively reasonably foreseeable outgrowths of primary crime
Accomplice - defenses
Common law - withdrawal, w timely notice to primary, severs liability
MPC - to withdraw, must either render prior assistance completely ineffective, make proper effort to prevent perpetration, or provide the police timely warning
