Parties
Must prove identity of accused and offence must be successful
Primary
Commits crime - does the act
Secondary
Aids - assist in commission e.g provides tools
Omits - fails to do something to help offender
Abets - instigates or encourages
Incites - rouse, stir up, stimulate someone to commit offence
Counsels - provides advice
Procures - sets out (plans) to see that offence is committed and making sure it does.
R v Bretts and Ridley
If no violence contemplated, however one party uses it, the other cannot be held accountable.
R v Renata
Where principal offender isn’t to be identified we must prove each individual was either the principal or party too.
Larkin v Police
Principle doesn’t have to know secondary was assisting him.
Probable consequence
Where there is a high chance of something happening even if it wasn’t directly discussed, both can be charged. i.e Both parties know offender A has a knife and plans to take it to rob a store, offender A stabs the owner and kills him. Offender B may not have directly made that decision’however, he was aware that offender A had the knife and therefore was a high chance it could have been used in their commission of an offence.
