A

A

Para 6.7.4 states that a SoC must be:

1) as brief and concise as possible and confined to setting out the bold facts - but not the evidence of them.
2) set out in separate consecutively numbered paragraphs.
3) one allegation per paragraph.
4) deal with the claim on a point-by-point basis.
5) set out in chronological order.
6) any matter which if not stated might take another party by surprise should be stated.

How is interest calculated?

A

1) according to the terms of a contract.

2) Statute:
i) Late payment of Commercial Debts (Interest) Act 1998:
- interest under the Act can be claimed at a rate of 8% pa above BoE reference rate on the date the debt became due for payment.
- the Act also provides for payment of a fixed sun between £40 and £100 compensation for late payment.

ii) s.35A SCA 1981
- this is at the court’s discretion
- the interest is 1% above BoE interest rate (commercial) and 8% above BoE interest rate (non-commercial).
- interest is claimed from and including the day after the cause of action arose.
