  • must be an offer to pay a single sum of money

A

By serving written notice of acceptance on the offeror. If the case has been issued, this must be filed at court.

A

The court will determine liability for costs unless parties agree.

The usual order is:
- C is awarded costs until the end of the RP
- the offeree pays the offeror’s costs for the period from date of expiry of the RP to the date of acceptance

The court must determine liability for costs unless the parties can agree

A

Claimant will only be entitled to costs relating to the part of the claim contained in the offer unless the court considers otherwise.

What happens if a Defendant's P36 offer is not accepted?
1. Trigger --> does C fail to get a judgment more advantageous than D's offer? 2. If yes, C pays D's costs plus interest from the expiry of RP and deals with their own costs. Loser will pay the winner for the period within the RP. this is known as a split costs order

What is taken into account when determining whether a judgment was more or less advantageous?
Money at the date of judgment Do not consider interest after this date!

What happens if the claimant obtains a judgment more advantageous than the defendant's Part 36 offer?
No effect of Part 36 offer on costs.

What happens if the Claimant's P36 offer is not accepted?
1. Trigger - is the judgment against D as good as or better than C's offer? 2. If yes, the court must order (unless unjust): - interest on the award at a rate not exceeding 10% above the base rate for some or all of the period from the end of the RP - costs from the end of the RP are asessed on an indemnity basis - an additional amount based on a percentage of the award (or costs if non-monetary), up to a total of £75,000

What is the interest rate imposed on the award if the judgment is at least as advantageous as the claimant's Part 36 offer?
Not exceeding 10% above base rate.

What must the court consider when imposing penalties for unaccepted offers?
* Terms of any Part 36 offer * Stage in proceedings when the offer was made * Information available to parties * Conduct of parties in giving information * Whether the offer was a genuine attempt to settle.

What happens if both the claimant and defendant have open Part 36 offers effective at the same time?
Both offers need to be considered in turn.

How is the Claimant's award calculated when the claim is subject to the fixed recoverable costs regime? | instead of the indemnity basis.
NOT the indemnity basis - instead the additional costs are 35% of the difference between the fixed costs for the stage reached when the RP expired and the stage applicable at the end of judgment.

What happens if the offer was made within 21 days of trial?
No P36 consequences even if the trigger is satisfied - unless the court abridges the relevant period.
