What are rules and give examples?
Guidelines governing a certain activity which only need to be obeyed by those partaking in the activity, such as school rules or sporting club rules
What are laws and give an example?
Guidelines by which society must abide by and are enforceable by police and courts, such as murder not being allowed
What is the order of court in Australia from lowest to highest?
Federal Magistrates’ Court, Family Court, Federal Court, High Court
What is the order of courts in Victoria from lowest to highest?
Coroners Court, Children’s Court, Magistrates’ Court, County Court, Supreme Court
What are the 2 main sources of law in Australia?
Parliament and courts
What is the system of government in Australia and explain it?
Federal system of government that governs all states and territories, therefore people in Victoria are subject to both federal and Victorian laws
What is the Australian Constitution?
Australia’s supreme law, providing a framework for all other laws and establishing the division of power between federal and state parliaments
When and why was the Australian Constitution passed?
1900, to ensure greater cooperation between the states
How had Australia been operating prior to the constitution?
6 self-governing British colonies since European settlement
What is legislation?
The process of making or enacting laws
What are statutes?
Written laws passed by a legislative body
What are acts?
Bills which have become laws
What is common law?
The body of law derived from judicial decisions of court
What is a bi-cameral system of parliament?
A parliament which contains 2 separate assemblies who must agree when new laws are made
Who is the Governor-General and what is royal assent?
David Hurley, approval for a bill to be passed or to withhold assent from a bill which has passed both houses
