  1. For horse and harness racing, the permittee’s racing permit requires the permittee to conduct a minimum of one hundred fifty-six days of live racing with an average of nine posted races on an average of five racing days each week at the permittee’s racetrack enclosure during the period beginning on October 1 and ending on the first full week in May, unless otherwise agreed in writing by the permittee and the recognized horsemen’s organization that represents the horsemen participating in the race meet at the racetrack enclosure, subject to approval by the department.
  2. For dog racing, the permittee is required to conduct a minimum of ten posted races on each of four days each week for forty-one weeks during a calendar year at the permittee’s racetrack enclosure.

Notwithstanding subsection B of this section, in counties having a population of seven hundred thousand persons or more but less than one million five hundred thousand persons, simulcasts may be received at the racetrack enclosure, and the permittee may offer pari-mutuel wagering on the simulcast racing at any additional wagering facility used by a permittee for handling wagering as provided in section 5-111, subsection A during a permittee’s racing meeting as approved by the commission, whether or not the simulcasts are televised to the additional wagering facilities and whether or not posted races have been conducted on the day the simulcast is received, subject to the following conditions:

  1. For horse and harness racing, the permittee may conduct wagering on dark day simulcasts for twenty days, provided the permittee conducts a minimum of seven posted races on each of the racing days mandated in the permittee’s commercial racing permit. In order to conduct wagering on dark day simulcasts for more than twenty days, the permittee is required to conduct a minimum of seven posted races on one hundred forty racing days at the permittee’s racetrack enclosure.
  2. For dog racing, the permittee is required to conduct a minimum of nine posted races on each of one hundred days during a calendar year at the permittee’s racetrack enclosure, unless a lesser number is otherwise agreed to by written contract entered into by February 1 of each year by a permittee and a majority of licensed persons then participating in a greyhound racing meeting as greyhound racing kennel owners.

Live racing and wagering on simulcast races shall be permissible in either daytime or nighttime, but, unless otherwise agreed by written contract that is submitted to the department between all the permittees in the same county, there shall be no live daytime dog racing on the same day that there is live daytime horse or harness racing in any county in which commercial horse or harness racing has been conducted prior to feb 1st 1971, and no live nighttime horse or harness racing on the same day that there is live nghttime dog racing in the same county. As a designated location, a written, verified claim for payment from a pari-mutuel pool shall be accepted by the permittee in any case where the permittee has withheld payment or has refused to cash a pari-mutuel wager. The claim shall be made on such form as approved by the dept and the claimant shall make such claim under penalty of perjury. the original of such claim shall be fwd to the dept w/in 48 hours

  1. In the case of a claim made for payment of a mutilated pari-mutuel ticket which does not contain the total imprinted elements required pursuant to r19-2-503(1) of these rules, the permittee shall make a recommendation to accompany the claim forwarded to the dept as to whether or not the mutilated ticket has sufficient elements to be positively identified as a winning ticket.
  2. In the case of a claim made for payment on a pari-mutuel wager, the dept shall adjudicate the claim and may order payment thereon from the pari-mutuel pool or by the permittee or may deny the claim, or may make such other order as it may deem proper.

Claims pertaining to a mistake on an issued or unissued ticket must be made by the bettor before leaving the seller’s window. Cancellation or exchange of tickets issued shall not be permitted after a patron has left a seller’s window ecept in accordance with written policies established by the racetrack permittee and approved by the dept. an ADWP shall abide by the most restrictive policy established by any of the racetrack permittees with which the ADWP contracts.

If an error occurs in the payment amounts for pari-mutuel wagers which are cashed or entitled to be cashed and, as a result of such error, the pari-mutuel pool involved in the error is not correctly distributed among winning ticket holders, the following shall apply:

  1. Verification is required to show that the amount of the commission, the amount in breakage, and the amount in payoffs is equal to the total gross pool. If the amount of the pool is more than the amount used to calculate the payoff, the underpayment shall be paid to the department for deposit into the state treasury.
  2. Any claim not filed with the permittee within 30 days, inclusive of the date on which the underpayment was publicly announced, shall be deemed waived, and the permittee shall have no further liability therefore.
  3. In the event the error results in an overpayment to winning wagers, the permittee shall be responsible for such payment .

A racetrack permittee shall ensure that a summary explanation of pari-mutuel wagering and each type of betting pool offered shall be is published in the racing program for every wagering performance. The racetrack permittee shall make the rules of racing relative to each type of pari-mutuel pool offered available upon request through permittee representatives at all permittee wagering locations and shall post a link to the department’s rules page on all permittee web sites.
