Parental responsibility and time sharing
Both parents have parental responsibility and time sharing rights.
Minor children are to have frequent continuing contact w/ both parents.
Standard: best interests of the child.
Shared parental responsibility
Both parents retain FULL parental rights and responsibilities.
Parents must be willing and able to cooperate for the well-being of the child.
Share parental responsibility is MANDATORY unless it is not in the child’s best interest and welfare.
Sole parental responsibility
One parent has ALL deision making rights regarding the child.
Other parent is unfit and unable to provide care for the child.
Applied when shared parental responsibility is NOT in the child’s best interests and welfare.
Parallel shared parental responsibility
Decision-making rights are split btwn the parents.
Usually based on a parent’s unique or special expertise or skills in a particular area.
Time sharing schedule
Plan specifying which parent child will be with at certain times.
Guidelines for overnights, weekends, holidays, travel, education, and childcare.
The court will establish this schedule if the parties cannot agree.
Ct may impose restrictions or conditions, but rarely denies timesharing.
Parenting plan
Required if time sharing w/ minor child.
Governs the relationship btwn the parties in making decisions for the child.
Sets for shared responsibilities, time-sharing schedule, and the methods of communication.
Ct may appoint parenting coordinator to help resolve parenting plan issues.
Ct may appoint mental health practitioner to make non-binding recommendations.
