A

Why is evidence limited?

A

1) Relevance: Only want the information that matters.
2) Reliability: Only want credible, reliable evidence to go to the jury.
3) Privileged: Jury cannot hear evidence that is protected by a privilege.
4) Constitution: The 6th and 4th amendments often limit what can and cannot be given to a jury.

Define: Stipulation

A

A stipulation is a proposed agreement made between opposing parties prior to trial. Stipulations often address contested FRE 403 Evidence.

Define: Motion in Limine

A

Motions made by either party prior to a civil or criminal trial to resolve important evidentiary issues. The motions are made outside the presence of the jury and ruled on by the judge.
