Overview Flashcards
1
Q
What are the two main topics that Civ pro covers?
A
(1) Forum selection or jurisdiction (are we in the right court? What law governs if in federal court?);
(2) Procedures we use once we are in the right court and that court is the federal court.
2
Q
On top of the two main topics, what are the two small discrete topics that are also included?
A
(1) Appellate review. (Can the appeals court review it and what can they do?)
(2) Claim and issue preclusion. (Once our claim goes to judgment, does that preclude them from litigating in a future case?)
