What conduct of the parties may the court take into account when making a cost order?
The conduct of the parties before proceedings were commenced, including the extent to which they complied with the Practice Direction—Pre-Action Conduct and Protocols, as well as their conduct during the proceedings.
What is the meaning of an order that there be ‘no order as to costs’ given at an interim hearing?
That each party will bear its own costs in the application whatever the outcome at trial
How are costs likely to be assessed at a fast track trial claim?
The general rule is that the court should make a summary assessment of costs at the conclusion of the trial. Where the court does not give an indication of the basis of assessment, costs will be assessed on the standard basis.
When can a minor bring a claim in relation for limitation period purposes in relation to personal injury?
3 years from when the disability ended (rather than month of damage)
