To whom can a suspect inform of their arrest?
When a person is arrested and held in custody, they are entitled to have a friend, relative or other person interested in their welfare informed i.e. flatmate.
Can a minor have a consultation with their solicitor before the appropriate adult is present?
Yes – the right to legal advice should not be delayed.
What should happen if a suspect initially declines legal advice but half-way through the interview changes his mind?
The interview must be stopped even if the interviewing officer believes there are grounds to delay his access to legal advice.
What action does a custody officer need to carry out if a suspect rejects legal advice and wants to go ahead with an interview?
At a minimum, make sure that reasons are recorded on the custody record, contact their solicitor and provide authority in writing for the interview to proceed.
When does the detention clock start for someone attending a police station after street bail?
At the time of their arrival.
