Bars person from holding a national security eligibility for access to SAP’s, Restricted Data, and Sensitive Compartmented Information without an expressed waiver if they:
-Have been convicted in any court of the U.S. of a crime, was sentenced to imprisonment for a term exceeding 1 year, and was incarcerated as a result of that sentence for not less than 1 year.
-Have been discharged or dismissed from the Armed Forces under dishonorable conditions.
- are mentally incompetent based on an evaluation by a duly qualified health professional.
And cannot be granted a security clearance if they:
-Are an unlawful user of a controlled or an addict
Bond Amendment (2008)
Streamlines the investigative and adjudicative process for the federal government.
Reduces adjudicative guidelines.
The PR were extended to address the backlog.
Intelligence Reform & Terrorism Prevention Act (IRPTA)
Controls the collection of personal information by the federal government.
Sets forth a requirement to publish in the federal register all systems of records for which personal information is collected.
Requires that the subject be notified why personal information is being collected, routine uses, and the impact of failure to provide the information.
