Classification of offenses
In Florida, felonies are classified as capital, life, first-degree, second-degree, and third-degree felonies. Misdemeanors are classified as first-degree and second-degree misdemeanors. Penalties are assessed according to class, with capital felonies requiring the most severe penalties.
Reclassification of certain crimes
Florida provides for the reclassification of certain crimes to the next highest degree if the defendant commits an offense and is in possession of certain items (i.e., bulletproof vests, child pornography, or weapons) or engages in certain activities (i.e., wears a mask, evidences prejudice, unlawfully takes a law enforcement officer’s firearm, or engages in acts of terrorism)
