Explain s214 OT act
214 arrest without warrant
Where an officer is satisfied on reasonable grounds arrest is necessary for
- witnesses (prevent interference)
- ensure appearance before court
- evidence (prevent caad)
- prevent further offending

214A beach of bail: breaching 2 or more previously, authority from YA SGT, and RGTB will continue breaching bail
Define “VICTIM”
(i) a person against whom an offence is committed
(ii) person who by means of an offence suffers physical injury/loss or damage to property
(iii) parent of i or ii
(iv) member of immediate family of victim who died/made incapable
For the purposes of s7 and 8 (access to services), a victim also includes:
- a person who by means of an offence suffers emotional harm
- a parent of a CYP who suffers emotional harm
- a person who has experienced domestic violence
- CYP residing with a victim of domestic violence
Define “IMMEDIATE FAMILY”
“A member of the victim’s family, whanau, or other culturally recognised group who is in close relationship with the victim at the time of the offence”
Includes:
- spouse, defacto
- child or step child
- sibling or step sibling
- parent
- grandparent
