Shall ensure a safe and healthful workplace.
Section 1. Declaration of Policy
The total cost of implementing a duly approved OSH program shall be an integral part of the operations cost.
Section 21. Cost of Safety and Health Program
Workplace Classification Based on Risks:
Low risk workplace
Medium risk workplace
High risk workplace
Presence of hazard or potential hazard within the company may affect the safety and/or health of workers.
High risk workplace
Every employer, contractor or subcontractor, if any, shall provide his/her workers free of charge, PPE for any part of the body that may be exposed to hazards.
Section 8. Workers’ Right to PPE
Covered workplaces shall have qualified occupational health personnel such as certified first-aiders, nurses, dentists, and physicians duly complemented with the required medical supplies, equipment and facilities.

In the implementation of the OSH program, safety officer shall be deployed or designated.

Section 5. Rights of the workers
If stoppage of work due to imminent danger occurs as a result of the employer’s violation or fault, the employer shall pay the affected workers their corresponding wages during the period of such stoppage of work or suspension of operations.
Section 24. Payment of Workers During work stoppage due to imminent danger
There shall be established package of incentives under such rules and regulations as may be promulgated by the DOLE to qualified employers and workers to recognize their efforts towards ensuring compliance with OSH and general labor standards such as OSH training packages,additional protective equipment, technical guidance, recognition awards and other similar incentives.
Section 28. Incentives to Employers and workers
Develop and implement suitable OSH program in format prescribe by DOLE. Program for establishment less than 10 workers and low risk establishment with 10 to 50 workers
Section 12. OSH Programs
A worker may file claims for compensation benefit arising out of work-related disability or death.
Section 27. Employee’s Compensation Claim
The employer, project owner, contractor, or subcontractor, if any person who manages,controls or supervises the work being undertaken shall be jointly and solidarily liable for compliance with occupational safety and health standards including the penalties imposed for violation thereof as provided for in this rules.
Section 22. Employers Responsibility and Liability
Any willful failure or refusal of an employer, contractor or subcontractor to comply with the following OSH standards below or with a compliance order issued by the Secretary of Labor and Employment or his/her authorized representative shall be penalized of the administrative fines.
Section 29. Prohibited Acts and its Corresponding Penalties
The worker has the right of refusal to work without threat or reprisal from the employer if, as determined by DOLE, an imminent danger situation exist.
Section 6. Workers’ right to refuse unsafe work.
Oversee the overall management of the OSH program in coordination with the OSH committee.
Safety Officer
Workers and their representatives shall have the right to report accidents, dangerous occurences, and hazards to the employer, to DOLE and to other concerned competent government agencies. They shall be free from any form of retaliation for reporting of any accident.
Section 7. Workers’ right to report accidents
It covers all establishments, projects, sites including Philippines Economic Zone Authority (PEZA) establishments and all other places where work is being undertaken in all branches of economic activity, except the public sector.

All safety and health personnel shall undergo the mandatory orientation of training on OSH as prescribed by DOLE.
Section 16. Safety and Health Training
Builder or contractor who visits, builds, renovates or install devices or conduct business in any establishment or workplace shall comply with the rule provisions and other regulations issued by Secretary of Labor and Employment.
Duties of the other person
To ensure OSH program is observed and enforced a safety and health committee shall be organized in workplaces.
Section 13. OSH Committee
All employers, contractors or subcontractors, if
any shall submit to DOLE all safety and health
reports, and notifications such as but not limited to annual medical report (AMR), OSH committee report, employer’s work accident/injury report (WAIR), and annual work accident/injury exposure data report (AEDR).
