Rabies Vaccinations
Cats, dogs and ferrets over 4 months.
Waiver can be issues by DVM.
Limitation on Possession of Exotic Animals
No person shall own/keep any exotic animal without proper license.
No person shall feed any wild animal.
Animal fighting prohibited
No person shall cause, sponsor, arrange, hold or encourage a fight between animal other than dogs (dog fighting is a felony).
Includes:
-Present at fight
-Owns, trains, transport, possesses, or equips
-Knowingly allows a fight to occur on any property owned/controlled
Subjecting animals to unnecessary suffering
No person shall:
-overdrive/overwork any animal
-cause unnecessary suffering
-Needlessly shoot, wound, capture molest, injure, kill
-Confine any animal in a vehicle that is life/health threatening
Improper Care of Animals Prohibited
No person owning/keeping an animal shall fail to provide it with minimum care and to keep it under conditions under which its enclosure is not overcrowded, unclean, or unhealthy.
Minimum care for animals
-Food (sufficient quantity)
-Water (tethered or confined)
-Sufficient structure to protect from wind, rain, snow, or sun
-Enclosure is overcrowded (length of animal + 6in)
-Enclosure contains more than 1 day`s elimination
Enclosure is likely to cause illness of animal
Abandoning Animals Prohibited
No person shall abandon any animal.
Use of certain traps Prohibited
No use, set, place, maintain, or tend any leg-hold trap or mechanical trap which is designed to capture or kill any animal and does not require the presence of a human operator.
Poisoning Domestic animals Prohibited
No person shall knowingly poison any domestic animals.
Limitation on lethal means of control for prairie dogs and birds.
Except as authorized by other provisions of this chapter, no person shall utilize lethal means of control for prairie dogs or wild birds or remove prairie dogs from the ground with the intent to kill them.
Who is allowed to cause death of a prairie dog or wild bird for humanitarian reasons?
The following persons are authorized to cause the death of a prairie dog or wild bird for humanitarian reasons: Humane Society of Boulder Valley employees, veterinarians, Colorado Division of Wildlife employees, City Park Rangers, City Wildlife Managers, or persons permitted under state or federal law as wildlife rehabilitators.
Damaging Prairie Dog burrows Prohibited.
No person shall damage any prairie dog burrow.
Killing wild animals prohibited
No person shall knowingly kill any wild animal protected by federal or state constitution.
Dyeing fowl/Rabbits
Selling Dog, cats and fowl limited
No person shall dye or color live fowl, rabbits, or any other animals or have in possession, display, sell, or give away such dyed or colored animals.
No person shall sell, offer for sale, or give away dogs or cats under eight weeks old or any other warm-blooded animals under the normal weaning period for the animal.
No person shall sell, offer for sale, or give away any fowl under six weeks old. It is a specific defense to a charge of violating this subsection that the fowl are sold or given away in lots of ten or more for commercial, agricultural, or scientific purposes.
Animals running at large
No person owning or keeping any animal shall fail to prevent the animal from being off the premises of the guardian or keeper and beyond such person`s supervision and control.
Dogs running at large
No person owning or keeping any dog shall fail to keep the dog on the premises of the guardian or keeper unless:
-Dog is on leash
-Within a vehicle or similarly confined without access to passers-by.

Animals on Mall Prohibited
No person shall bring an animal onto the mall or possess an animal on the mall, regardless of leash/confinement. But a person with an animal may cross the mall in a NB or SB direction at 11th street, Broadway, 13th street, 14th stress or 15th stress.
Removal of Animal Excrement Required.
No person owning or keeping any animal shall fail to prevent such animal from defecating upon any property other than the premises of the guardian or keeper.
Barking, Howling, or other unreasonable animal noise prohibited.
No person owning or keeping any animal shall fail to prevent such animal from disturbing the peace of any other person by loud and persistent or loud and habitual barking, howling, yelping, braying, whinnying, crowing, calling, or making any other loud and persistent or loud and habitual noise, whether the animal is on or off the guardian’s or keeper’s premises.
Charging a person for violating Unreasonable animal noise
No person shall be charged with violating this section unless a written warning was given to the person by an agent or employee of the city within twelve months preceding the first date alleged as a date of violation in the complaint. Such warning is sufficient if it recites Subsection (a) of this section and states that a complaint has been received that an animal of which the defendant is a guardian or keeper is disturbing the peace of an individual. A warning is given under this subsection if it is personally given to the person owning or keeping the animal or if it is mailed first class to such person. The city manager shall keep records of all warnings given, and such records are prima facie evidence that such warnings were given.
Aggressive Animals Prohibited
No person shall own or keep any aggressive animals.
Bites, Claws, or attempts to bite/claw
Specific defenses for aggressive animals who was bitten/clawed
-Attacking or provoking animal
-Unlawfully entry into property
-Unlawfully entry into vehicle
-Attempting to assault another person
-Attempting to stop a fight between the aggressive animal/other animal
-Attempting to aid aggressive animal
Specific defenses for aggressive animals (owning/keeping)
-Aggressive animal was defending itself, its young or its guardian
-Animal that was bitten/claw/injured was on aggressive animals’ property or in vehicle
Animals as Nuisance Prohibited
-Violates “Animals Fighting Prohibited”, “Subjecting Animals to Unnecessary Suffering” or “Improper Care of Animals Prohibited” with safety/health hazard, damaging the property of another, or creating offensive odors.
-Warning must be given within 12 months preceding the first date.
Nuisance Cat Prohibited
You can not own a domestic house cat from damaging the property of another.
Disposition of Dead Animals
When any animal dies in the city, no person owning or keeping it shall fail to remove the body in a lawful and sanity manner.
What are the time limits for rabies observation & impoundment?
10 days for rabies observation
Owners have 5 days to claim pet
Emergency Impoundment of Animal
When, in the opinion of the city manager, an animal constitutes an immediate danger to the community, or an animal is itself in immediate danger due to improper care or treatment, the city manager may cause that animal to be impounded.
Conditions for emergency Impoundment of Animal
-Pending criminal case or administrative forfeiture action: city manager attempts to notify the parties
-No pending criminal case or administrative forfeiture: action shall be filed within 72 hours
-Within 72 hours, city manager shall submit written reports to the court
Peace Officer may Destroy Dog
Violation of “Dogs running at large prohibited” and dog is a threat to the safety of any person, domestic livestock or wildlife.
Injuring or Capturing Wild Birds Restricted
It shall be unlawful for any person in the city knowingly to shoot at, wound, kill, capture, ensnare, net, trap or injure any wild bird to damage the eggs/nest of any protected bird.
Affirmative Defenses for violating: Injuring or Capturing Wild Birds Restricted”
-Capture/injury was accidental to removing that bird/nest from a structure/covering over a sidewalk.
-Capture/injury was required in order to protect the safety of existing structure or safety hazard. (need permit)
-The capture & release was accomplished for purely humanitarian purposes
-The capture/injury occured in conjunction w/ official professional activities of animal treatment
Requirements for Special Permits for killing/capturing/releasing birds/prairie dogs
-Must constitute a health hazard
-Must be removed in order to permit completion or maintenance of a public improvement project
-Applicate must show proof in writing that they have taken reasonable steps to control the situation
Requirements for Special permit for destroying Prairie dog burrows
-The legal parcel or lot on which burrows may be damaged had no prairie dog habitation for a period of at least 365 days
-Following the period without prairie dog habitation, at least one but not more than five new burrows were established
-The landowner wants to be allowed to damage the new prairie dog burrows as part of an ongoing program to halt new colonization
-No permit shall be issued pursuant to this subsection between March 1 and June 1
Limitation on Keeping of Domesticated Animals
-No person shall own or keep any swine, hogs, or pigs.
-No person shall own or keep any horse, goat, sheep, cow, llama, burrow, or other equine/bovine animal unless such person has a total lot area on the lot of one-half acre per animal plus its young under 6mos.
