In all matters relating to the administration or application of this Act ( other then the yourh justice parts of the Act) the well being and best interests of the child or young person are the first and paramount consideration, having regard to the principles set out in section 5 and 13.
What does section 14 relate to?
Identifies children and young people ‘In need of care and protection’ defined.
That the child or young person is suffering, or is likely to suffer, serious harm in the following instances;
Being abused physically, emotionally or sexually

Can a child or young person be removed under Section 42? And why?
Yes, a child or young person can be removed or detaind if a police officer believes that they are in danger of serious harm or death.

Explain Section 39?
Place of safety warrant
If a police officer believes that a CYP has suffered or is likely to suffer abuse then police can enter and remove / detain CYP and place in care of OT.
Explain Section 48?
If a CYP is found unaccompanied the Police can take the CYP and deliver home to parent. If parent doesn’t want CYP then deliver to OT.
Care and protection; what is the police role?
Police must investigate offences where alleged child abuse of any form is reported, the role of the police is to investigate the allegation, in co-operation with Oranga Tamariki.
