What does ‘WEEP’ stand for? (Section 214)

A

Rights Caution happens before this

Witness/Victims - Stop the offender interfering with them/Police to protect them.
Ensure - that offender is able to be summonsed (or an alternative action) by providing correct information (name and address)
Evidence - The offender failing to provide evidence with a consent search. (Cannot warn before arresting).
Prevent - from future offending occurring

What are the two exceptions to section 214?

A

Arrest is necessary to carry out breath/blood-alcohol provisions of the Land Transport Act 198; OR
If the offence has a maximum penalty imprisonment for life or for at least 14 years AND the arrest is required in the public interest.
