When Informed Consent is Not Required (HCCA)

A
  1. Immediate treatment necessary to save a life or prevent serious
    harm to client AND the client’s consent or a substitute consent is not available
  2. When client is deemed incompetent, must obtain appropriate substitute consent
  3. When client has completely, knowingly, and voluntarily waived the right to be informed (in writing)
  4. “Therapeutic privilege:” Practitioner can withhold information because it will have detrimental effect on the client’s health if disclosed

Psychologist responsibilities under PHIPA

A
  1. Get consent from clients for collection, use or disclosure of personal information
  2. Client has right of access to their personal information and to challenge the accuracy and completeness
  3. Personal information can only be used for the purposes for which it was
    collected
  4. If you will use the information for another purpose, must get consent
    again
  5. Personal information must be protected by security safeguards, which you
    let the client know about. If there is a privacy breach, must let client know
    ASAP
  6. Provide written statement describing information practices.
