personal info collected, used and disclosed by municipal and prov government institutions are subject to virtually identical acts:
- municipal freedom of information and protection privacy act (MFIPPA)
- freedom of info and protection privacy act (FIPPA)
What does MFIPPA apply to?
applies to almost all municipally-created govt departments, agencies and organizations (ie. municipal governments, boards of health, school boards, municipal police departments)
what does FIPPA apply to?
prov-created govt institutions like ministry of health, public and psych hospitals, universities, colleges and OPP
What are the 2 broad functions of MFIPPA and FIPPA
- subject to specified exceptions, provide indv with the right to access general and personal info held by both government institutions
- acts seek to protect privacy by restricting the right of these governments to collect, use and disclose indv personal information
what is the term record defined as
is defined as any record of information however recorded
personal information is defined as
recorded information about an identifiable idv
what do the acts not apply to ?
health, counselling and care professionals who work in private sector or to their regulatory colleges or bodies
- consequently, a nurse employed by the school board would be governed by, among other things the education act and MFIPPA
- however, a nurse governed in a private practice would be governed by neither
