Serious bodily injury per 243(f)(4) PC:
- loss of consciousness
- concussion
- bone fracture
- protracted loss of impairment of function of any bodily member or organ
- wound requiring extensive suturing
- serious disfigurement
Use of force: dept personnel may use only that force which is objectively reasonable:
- defend themselves
- defend others
- effect an arrest/detention
- prevent escape
- overcome resistance
Deadly force: LE officers are authorized to use deadly force to:
- defend themselves/others from what is reasonably believed to be imminent threat/death/serious bodily injury
- apprehend person who officer believes has committed felony involving use or threatened use of deadly force, except ADW w/vehicle
- necessary to apprehend when person has committed ADW vehicle and officer believes has resulted in serious injury/death
Use of force options:
- control holds
- ECD
- personal weapons
- deadly force
- baton
- less lethal
- OC
Officers responsibility when witnessing excessive use of force by peace officer:
- officers action must be reasonable and prudent, based upon the circumstances
- officers actions should include verbal and or physical intervention necessary to mitigate use of excessive force
Uniformed employees should not place their finger on the trigger of any firearm during a tactical situation except when:
- actually firing firearm
- when firearm is pointed at an identified target and use of deadly force is justified
Examples of when finger ON trigger is appropriate:
- known/suspected felony refuses to show their hands or follow instructions during felony stop
- while conducting building search a suspect is located but refuses to come out from concealment instructions
- when confronted with suspect who advances toward officer, ignoring all orders and commands, and is armed with weapon capable of causing serious injury/death
Officer may discharge firearm at animal under following conditions:
- self defense or to defend another person from serious bodily harm
- when necessary to destroy a critically injured animal, provided such actions can be accomplished with safety to persons/property
- when necessary to destroy suspected rabid animals or animals attacking livestock
Officer properly engaged in attempting to arrest misdemeanant can resist attack and may take life in own defense when:
Attack is sudden and danger is imminent, even though it may be shown the safety could have been gained in flight
Officer in pursuit of stolen vehicle must consider:
- possibility vehicle is being driven by innocent party against their will
- driver of vehicle does not comprehend nature of evasion
- mere reporting of vehicle as stolen does not automatically equate to a felony (repossessions and other civil actions and domestic disputes often result in reporting a vehicle as stolen)
Shooting of injured animal should be undertaken as last result. Following steps SHALL be taken prior to shooting:
- supervisors approval to destroy animal should be obtained w/consideration of geographical location and employees experience
- if possible, owners permission to destroy
- all bystanders must be protected by removal to a safe area behind shooting officer
- area behind and sides of animal should be protected in event of over penetration
- when shooting in head chances of ricochet are reduce when shot from 90 degree angle
- skull structure of large animals is predominantly thick, thin areas in skill permit bullet to penetrate
Following discharge of firearms incidents SHALL Be reported:
- intentional discharge of firearm by an officer while in duty
- intentional discharge of any firearm, by any officer while off duty, in direction of, causing injury, to any person, or toward property of another person without their specific permission
- accidental discharge of any firearm while on duty
- Off duty accidental discharges of may firearm that may be carried concealed under authority of California peace officer status
- warning shots fired by an officer while off duty in an attempt to apprehend person for any crime
- intentional or accidental discharge of a firearm by non uniformed employee while on duty
Officer SHALL submit memo to their commander after shooting animal according to policy. Memo SHALL be submitted to appropriate division a maintained for ___

- allied agency has been notified to discontinue participation but refuses to do so
