A

The objective principle is a principle which states that the offeror need not expressly state that he wishes to be bound by his offer.
provided that a reasonable man believes that the offeror conducted himself in a manner in which he was assenting to the terms proposed by himself to the other party, and based this belief the other party entered into a contract with him, the offeror is bound by his offer.

A

If I am selling my laptop, at say k5,000 and then someone asks me how much am selling it for, and I tell them the price, that does not amount to an offer, it’s merely an invitation treat.

Also, if that same person says i’d rather buy it at k3,000, that is also not an offer but an invitation to treat.

What is a unilateral contract?

A

It’s a contract in which the offeror promises to fulfill a promise based on the performance or occurrence of a specified act.

What is an auction sale without reserve?

A

It an auction sale in which the goods being sold have no minimum price set. The auctioneer in such cases makes an implied undertaking to make a sale to the highest bona fide bidder.

What is an auction sale with reserve?

A

It is one in which there is a minimum price which has been set for the sale of the goods at an auction.
This is not an offer, but an invitation to treat, because the auctioneer is not obligated to make a sale until he has reached the minimum price for sale.

What is a pre- condition?

A

It is something that must be fulfilled in order for the offer to remain valid.
Eg: The university of Manchester gives you a conditional offer saying, you can come to our university if you manage to get 2 AA’s and 1 B in your A- levels, but then you only manage to get 3 CCC’s. It means that the offer is no longer valid.

What is a counter- offer? and what is it’s effect?

A

A counter- offer is a new offer made by the offeree, with new terms. A counter offer always destroys the original offer.

List 3 rules that must be followed in order for revocation to be effective.

A
  1. The offer must be withdrawn at any time before it has been accepted.
  2. The offeror must inform the offeree that the offer is being revoked. (Note. this can also be done by a reliable source.)
  3. In unilateral contracts, once performance has commenced, the offer cannot be revoked.
