Vicarious liability
When bar staff breach the act they are liable legally for the actions. However, the licensee or manager is also legally liable for the offences committed by the bar staff
Proof of age documents
Passport New Zealand or overseas
New Zealand drivers license
Kiwi access card issued by hospitality New Zealand
 Supplying alcohol to minors elements (s241)
Every person commits an offence who
Supplies alcohol to a minor
s241 defence
A. as a parent or guardian of the minor supplies to alcohol in a responsible manner
B. Believes on reasonable grounds that the minor is not a minor
C. Believes on reasonable grounds that they had the express consent of the parent or guardian and supplies the alcohol in a responsible manner
s256 Allows a person to be on license premise outside licensing hours
$10,000 fine to licensee and/or
manager.
Prosecution would not have to prove that the person was supplied with alcohol. Would only have to prove the person was on the premise at any time later than 30 minutes after the premise we are required to close.
s252 Allows intoxicated person to be or remain on license to premise
$5000 fine to licensee and/or manager
Defence if licensee/manager proves they took reasonable steps to take the person to a place of safety or remove them when they became aware of the situation
