What is vicarious liability?
The Licensee is legally liable for any offences commited by his/her staff.
What are some defences for supplying alcohol to minors?
If the person supplying the alcohol:
- is the parent or guardian and supplies the alcohol in a responsible manner.
- believes on reasonable grounds that the minor is not a minor
- beleives that he/she has the express consent of the parent
What are your powers to enter licenced premises section 267(1)?
At any reasonable time
enter and/or inspect premises
to ascertain if licensee or manager is complying with the Act/license
What are your powers to enter licenced premises section 267(2)?
at any time
enter and/or inspect premises
if they have RGTB any offence against the Act is being committed on those premises
What is fine for failing, refusing or delaying police entry?
$2000
When may Police have the power to close licensed premises?
- if it feared that serious will break out
- to regain control of an incident
Any closure lasts no more than 24hours or until good order is restored.
If you have RGTS anyone has or is attempting to commit any offence against the act, you have the power to demand what information?
- Name
- Address
- DOB
can require proff of ID if RGTB details are false.
If a person fails or refuses to provide details….
WARN them they will be arrested for refusing/failing to supply information
