What is the definition of a public place?
“A place that at any material time
Is open to, or used by the public
Whether free or on payment of a charge,
And whether any owner or occupier of the place is lawfully entitled to exclude or eject that person from that place,
And includes any: aircraft, hovercraft, ship, ferry, other vessel, train, vehicle
That is carrying or available to carry passengers for reward
And includes the interior of any vehicle which is in a public place
What is the definition of Fights?
Punching, striking, mauling, wrestling between two or more WILLING PARTICIPANTS
What do you need to consider when dealing with Street Disorders?
Time, place & circumstances
What are the elements of Offensive OR Disorderly Behaviour?
1. In a public place OR Within view of a public place 2. Behaves in an offensive manner OR Behaves in a disorderly manner
What is the definition of offensive?
Arousing feelings of anger, resentment or disgust that causes a disturbance to public order
What is the definition of disorderly?
Seriously disruptive manner that causes a disturbance to public order
Explain Disorderly Assembly
A group situation with 3 or more who present fear or violence
When can you arrest someone for Urinating in a Public Place?
If the constable has seen the act AND the offender fails to give their name and address on demand
What are the elements of Resisting Police?
- Resists
OR
Incites or encourages any person to resist - Any constable/authorised officer in the execution of their duty
What is the definition of resist?
Requires some degree of force by the offender
What are the elements of Obstructing Police?
- Intentionally obstructs
OR
Incites or encourages any person to obstruct - Any constable/authorised officer acting in the execution of their duty
What is the definition of obstruct?
Deliberately making it more difficult for a person to carry out their duties
