4 elements of Robbery
Theft
Accompanied by violence
OR
Accompanied by threats of violence
To any person
OR
To any property
Used to extort the property stolen
Or
To prevent or overcome resistance to the stolen property.
Accompanied by violence
Violence before or at the time of theft
Accompanied by threats of violence
Threat of violence before at the time of the theft, demonstrated by conduct or words.
Theft
All elements of theft need to be present
Used to extort the property stolen
The violence or threats used by the offender are sufficient to cause the person to hand over the property against their will.
“Give me the money or I’ll beat you up”
“Smash the car or give me money”
To prevent or overcome resistance to the property being stolen
The property is taken by the offender after any resistance to its taking has been prevented or over come.
“Snatching a bag but lady holds on”
“Punching”
Aggravated Robbery
A robbery that causes harm to any person and that requires 2 or more people
Assault with intent to rob
Assaults with the intention to rob any person.
Demanding with intent to steal
Demanding any property from any persons with intent to steal. Section 239(2)
