Relevance
Evidence is relevant if it has any tendency to make a fact that is important to the case more or less probable than the fact would be without the evidence.
Unfair Extrapolation
When a witness creates a material fact not included in his or her official record. A material fact is one that would likely impact the outcome of the case.
Response: Witnesses may make fair extrapolations from the materials. A fair extrapolation is one in which a witness makes a reasonable inference based on his or her official record.
More Prejudicial Than Probative
The court may exclude relevant evidence if its probative value (its value as proof of a fact) is substantially outweighed by the probability that its admission creates substantial danger of undue prejudice, confuses the issues, wastes time, or misleads the trier of fact.
