When is a person Resident in NZ?
If they have PPOA
Present in NZ for 183 days in any 12 month period
Are away in service of NZ government
When does a person cease to be a resident?
Cease to have PPOA
AND
Are absent from NZ fro more than 325 Days in a 12 month period
What if someone leaves part way through a day?
Part days will be counted as whole days
What is a place of Abode
A dwelling available as a home when needed
What is permanent
Must habitually reside on lasting rather than a temporary basis
When will a transitional resident be taxed
On employment or supply of services income sourced in NZ while transitional
When is a person transitional
They are NZ resident
Have been nonresident for a continuous period greater than 10 years previously
have not been transitional before
Didn’t elect to not be transitional
When does transitional residency end
Earlier of:
- the day they stop being NZ resident
- Last day of 48 month period after the person became resident
When is a company resident in NZ
If:
- Incorporated in NZ
- Head office in NZ
- Center of management in NZ
- Directors control the company in NZ even if directors decision making occurs outside NZ
Where is business and contract income sourced?
It is sourced in NZ to the extent business is carried on in NZ
