The state Board of pharmacy consists of at least nine pharmacists who have been licensed in the state of New York for at least five years.

Non-Resident Pharmacy Requirements to keep NYS Registration
-Maintain records of shipments to NYS
-Supply information upon request
-Provide agent of record which has to be a NYS resident
-Provide a toll free telephone # that is located on the label affixed to each drug
-Number should allow for communication between a NYS patient and a pharmacist who has access to records during normal business hours and >40 hours/week
-Must be licensed in the state they are located and NYS
In the situation of a complaint against a Non-resident Pharmacy that is not an emergent issue to public health, the Department of Health will not prosecute the complaint if the home state of the pharmacy acts within:

Exceptions to electronic prescriptions
Veterinarians, out of state physicians, VA, temporary technological/electrical failure, prescriber has a waiver (due to financial or technological reasons, should not exceed 1 year, physician cannot transmit in a timely manner.
With the exception of veterinarian and out of state prescribers, the reason for the non-erx must be documented in the patient’s chart at the prescriber’s office.

What is a pharmacist authorized to do if the generic or biologic equivalent of a drug is not available?
In this situation when the generic is not available. the pharmacist can dispense the brand as long as it is the same price as the generic or is a medical emergency. The requires documentation of the date, time, and nature of the medical emergency on the back of the prescription.

CE Requirements
