Collective Bargaining
A Process where by workers meet their employers in order to negotiate the terms and conditions of employment applicable to each worker
- Work schedule/ hour, break times, benefits (HC, group insurances), wages, vacation pays, holidays, sick leave + grievances
- Follow the current agreement even when expired until a new agreement has been agreed.
Collective Agreement
Establishes orderly relations between the parties to set working conditions of employees, and to facilitate the settlement of labour problems
- If expires before new collective agreement is completed, terms & conditions of the old collective agreement usually still applies.
Grievance Procedure and Arbritation
Grievance is a claim that one or more of the provisions of a collective agreement have been violated, accompanied by a request for compensation.
- Grievance procedures are negotiated as part of the terms of the collective agreement
1. A written submission: identifying what condition were breach
2. Union rep to file the papers
3. Binding arbitration
Arbitration is the settlement of a dispute by a person or persons chosen to hear both sides and come to a decision.
Obey and Grieve Rule
- I will Follow you superior orders even though the collective agreement is breach
- ** Rational**: patient safety comes first; the rights and needs of the patient comes first. Failure to provide the care will result in misconduct of pt abandonment
Roles to Enforce the Collective Agreement
- Settle disputes agreements through processing grievances
- Provide labour education, establish standards in workplace
- Negotiate wages, benefits, and standards of employment
- Promote and defend the professional, socio-economic, educational and moral interest of its member nurses
- Negotiate, interpret and apply collective agreements
- Distribute information on professional and union matters
- Recruit new members
- Helps consolidate & promotes the professional status of nurses
- Acts as a rep with the government & employers’ groups
