Define: Aggrieved person
Any person who is directly affected by an order or decision.
Define: Compliance Notice
A response, in writing, to an order of an officer, describing the extent to which each item in the order has been complied with.
Define: Constructor
A person who contracts for work on a project or does work on a project themselves.
Define: Contractor
A person who contracts for work to be performed at the premises of the person contracting to have work performed. Does not include a dependent contractor or constructor.
Define: Contracts for Work
Contracting to perform work or contracting to have work performed.
Define: Council
The OHS Advisory Council established pursuant to OHS Act.
Define: Dependent Contractor
A person, regardless of contract or use of own tools, vehicles, etc., who performs work for another where they are: a) economically dependent on the hirer b) obligated to perform duties mainly for the hirer c) more like an employee than an regular contractor.
Define: Division
The OHS division of the Department of Labour Skills and Immigration.
Define: Employee
A person hired to perform work. Includes dependent contractors.
Define: Employer
A person who hires one or more employees or contracts for their services. Includes constructor, contractor, subcontractor.
Define: Owner
Trustee, receiver, mortgagee in possession, tenent of premises used as a workplace, or one acting on their behalf.
What is the OHS division of DLSI responsible for?
The reasonsble standards for protection of health and safety of employees and self-employees.
Prepare and maintain stats and info relating to those parties. Assistance to those concerned with OHS in how to maintain standards for protection of health and safety. Promote/conduct studies/research projects in OHS. Encourage/Conduct educational programs. Annual OHS Act review submitted to council. Any directions of Minister or council.
Explain the accident fund.
Pays costs of Division and cost of education and research in OHS. Fund collected by WCB.
Under Employer Duties (s13. 1) what shall they take every precaution resonable to do?
- Ensure health/safety of persons at/near workplace.
- Provide/maintain equipment, materials etc.
- Provide info, training, supervision, facilities as necessary for health/safety
- Ensure employees supervisors etc. are aware of hazards in workplace.
- Ensure employees familiar with proper use of equipment, and PPE
What shall employers do under s.13. 2?
- consult and cooperate with JOHS committee or representative.
- cooperate with anyone performing duty required in the act.
- Provide additional training to committee or reps as needed
- comply with act/regs ensure employees comply
- establish OHS policy or program.
