nonsuit
voluntary withdrawl of a claim p has made
p has absolute right to nonsuit at any time before
motion to strike has been sustained, jury retires to deliberate, case has been submitted for decision
first nonsuit
matter of right subject to three conditions set above
subsequent nonsuits need
consent of other side or permission by judge
party taking nonsuit may refile
any time before SOL expires or 6 months of order, whichever is longer
can p nonsuit if there is a pending counterclaim, crossclaim, etc
no unless it can be independently adjudicated
courts have power to control, modify, vacate for
21 days after entry and no longer
What is a final order?
Ct is done with the case and judgment becomes final and beyond the control of trial court after 21 days of entry of judgment
demurrer
considered final if no leave to amend; if they do not file after leave of maned then it is final
pleas in bar and motion for summary judgment
considered final
order granting motion to strike is not
final unless also express exters summary judgment
party may move for the court to enter a judgment notwithstanding the verdict or order new trial if
finding contrary to evidence or shocks the conscience
once a judge sets aside verdict
he cannot revive it
