A
  1. the risk was foreseeable 2. risk was significant 3. in the circumstances a reasonable person in the same situation would have attempted to mitigate the risk

What are the exceptions?

A
  1. Wavier was signed (though, the wavier is only legal if what it claims is true. If the operator has failed to maintain the equipment to the standard proposed in the wavier the operator/company is still liable)
  2. good samaritan - as long as they’ve acted in good faith and without payment
  3. a person who donates food in good faith - as long as it was safe for consumption at the time it left their possession or control
  4. volunteers - unless they were engaging in illegal activities

A

You must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour - ur neighbour is who you owe duty of care to :)
