161 : How many Nominated Supervisor’s must you operate with
Its an offence to operate without at least 1 nominated supervisor.
162: Offence to operate Unless a Responsible Person is Present
Which one of 3 responsible persons must be present.
One of the following must be present:
1 - The approved Provider
2 - A nominated Supervisor
3 - A person in day to day charge
162A : What must the person in day to day charge and the Nominated Supervisor have completed
The person in day-to-day charge and the Nominated supervisor must have successfully completed the child protection training.
163 : Offence relating to appointment or engagement of Family day Care Coordinators
Family day care providers must ensure that at all times the prescribed minimum number of qualified persons are employed or engaged as a family day care co-ordinators to assist with
a) The operation of the family day car service
b) To support, monitor and train the family day care educators of that service.
The persons qualifications must be prescribed by the national regulations

Who must be available to provide support to the educators?
164A: Offence relating to the education & care of children by Family Day Care service
164: One of the following must be available to provide support:
1. The approved provider
2. a nominated supervisor
3. a person in day-to-day charge
164A: Must be an educator except in the circs prescribed in the National Regulations and must not be educated by any other person at that residence.
165 : Offence to inadequately supervise children
Approved Providers Nominated Supervisors and FDC Educators must ensure all children are adequately supervised at all times.
166 : Offence to Use Inappropriate Discipline
AP - NS - Staff Members or Volunteers and FDC Educators must ensure that no child is subject to:
1 - Any form of corporal Punishment
2 - Any unreasonable discipline
167 : Offence Relating to Protection of Children from Harm or Hazard
AP - NS and FDC Edu. - Must ensure every reasonable precaution is taken to protect children from harm or any hazard.
168 : Offence Relating to Required Programs
Approved Providers and Nominated Supervisors must ensure a program is delivered:
. Based on the development needs, interests and experiences of each child

2) A parent or family member
3) Emergency Services
4) Permitted under working with children law
171 : Offences relating to direction to Exclude Inappropriate Persons
The Regulatory Authority may direct the AP or NS to exclude a person if they are satisfied the person is an inappropriate person for as long as they see fit
Inappropriate Person
1) Person who may pose a threat to the children’s health, safety or wellbeing
2) Who’s behaviour or state of mind would be inappropriate for the person to be on the premises.
