What is a mutual will?
A mutual will arises when there has been an agreement between two people to make wills in similar terms to achieve agreed results.
Thus creating a constructive trust
Leading case of mutual wills?
Stone v Hoskins 1905
Trust created by the agreement arises when the first person dies.
Until that date each person has freedom to make a new will outside of terms.

Re Dale 1993 - Aim of the principle was to prevent second testator being defrauded
