What are the 3 authorized Local Committees?
- Independent local committee (ILC)
- Special independent local committee (SILC)
- An independent local committee with a comprehensive plan (approved by the district committee) (ILC + CP)
What is an Independent Local Committee / ועדה מקומית עצמאית and for how long are they independent?
- Established by Minister of the Interior as independent for a period of up to 5 years
- Must submit a comprehensive outline plan within the 5 years
What are the conditions of an Independent Local Committee? ILC
An ILC will take place on the condition that there is:
1. A professional, efficient and serviceable system for planning and licensing
2. A planning law enforcement system
3. A computer system
4. Minister-appointed opinionated representatives
What does the Independent Local Committee have extensive powers to do? ILC
Has extensive powers to approve plans that change a plan approved by the district committee, and add construction rights to it.
What 15 things are under the authority of an Independent Local Committee? ILC
- All ordinary local committee powers
- They can increase to the total area allowed for construction in the District Committee plan, for:
- Employment and hotel areas
- Service areas
- Public spaces
- Parking lots
- Underground floors
- Commercial uses in employment lots
- Private areas in public buildings
- Add uses (ex. kinder) in residential areas
- Add uses to employment or comm lots
- 25% increase in construction area in a plan that includes affordable housing
- Change one type of employment zoning to another, or to a hotel zoning, as well as adding employment uses
What is a Special Independent Local Committee, and under what condition does it exist? SILC
A special independent local committee is:
- Appointed by the Minister of Finance
- Exists on the condition that you work professionally and efficiently.
What 3 elements are under the authority of a Special Independent Local Committee? SILC
- All ordinary Local Committee powers
- All powers of an ILC
- Authority to approve plans for Evacuation and Construction and plans in Urban Renewal complexes (defined by the District Committee)
What is an Independent Local Committee with a Comprehensive Plan? ILC + CP And who is it approved by?
An Independent Local Committee with a Comprehensive Plan:
- Approved by the district committee
- Remains only with the powers of a regular local committee (loses ILC / SILC powers)
What are the 3 elements under the authority of the Independent Local Committee with a Comprehensive Plan?
The ILC + CP authority has all normal local committee powers (except plans that change the master plan), and can approve:
- A residential plan at hand, even if it does not correspond to the comprehensive plan
- All plans that correspond to the overall outline plan
What are the 5 factors of a Comprehensive Local Outline Plan?
Comprehensive local outline plan:
- Outline for decision-making
- Avoid rigid instructions; includes instructions that reduce the powers of the Local Committee
- Binding legal and regulation documents
- Must include land zoning and their areas, open public areas, guidelines for infrastructure areas and the height of buildings
- Does not allow the issuance of a building permit
What is the role of the Comprehensive Local Outline Plan? How long ahead does it look?
Its role is to outline the directions for the renewal and development of the settlement in the long term (20 years).
What is bypassing a Local Committee? What 5 elements can they bypass the Local Committee regarding?
A government office/government company who works with the development of buildings and infrastructure, may bypass the Local Committee and submit to the District Committee a plan regarding:
- Road and infrastructure
- Residences and ancillary areas (at least 400 units)
- Public housing
- Evacuation-construction
- Conservation site
What is housing within reach?
Housing within reach is the inventory of apartments for long-term rent. (the 6th addendum to the law), and can be within:
- A normal price
- Or a reduced price; intended for those who are eligible (the government has decided exactly who is eligible) and basically they always do a lottery between them.
What are the conditions of housing within reach?
Conditions:
- At least 25% of apts for rent will be at a reduced price, and their area will not be less than 20% of the total housing available.
- Sole ownership, duty of management and proper maintenance.
- Rental at a reduced price - The rent price will be about 20% lower than the market price. (for those eligible who won the lottery, for a period of min 20 years)
