No person shall hawk or peddle any fruits or vegetables until he has obtained a license UNLESS
a. Engaged in the pursuit of agriculture; or
b. Such articles are the product of the vendor’s labor or labor of his family
Enforcement of Replica Firearms
a. Under 18: confiscate and notify parents or guardians that they may pick up the replica firearm at the district station after 24 hours
i. Cannot arrest juvenile
b. 18 or older: confiscate and inform them that they can pick up the replica firearm after 24 hours
c. 1st offense = only seize (any age)
d. 2nd offense = fine $50 (allowed to arrest on 2nd offense if it is not a juvenile)
Defacement of Property and Possession of Certain Items
a. No person shall be under 18 years of age, carry or use any paint or marker which is not water-soluble (permanent) and has a point/writing surface in EXCESS of one-half inch
Graffiti Removal
a. Owner shall remove graffiti within 30 days of the time the owner knows or reasonable should have known by calling Graffiti Busters (program wherein the city, at its expense, removes the graffiti from public space and privately owned properties upon request)
b. Owner may be exempt if Graffiti Busters is no longer in operation AND the owner lacks the financial ability to remove the graffiti
Removal of Snow and Ice
a. Snow: cannot remain for more than 3 hours between sunrise and sunset
b. Ice: must make the ice level and cover it with sand, sawdust, or other appropriate material that will prevent slipping
Unlawful Games
No person shall expose any table or device to play any games of hazard/chance or play any such game or any other unlawful game in any street
Drinking Alcoholic Beverages in Public
No person shall drink any alcoholic beverage or possess an open container while in or upon a public way/right of access or private prop without consent
a. If they know they are in the wrong (at a big event, posted signs, they put down the container and try to walk away), can arrest
b. If they do not know, can fine but NOT arrest
Unlawful for any person to ride a skateboard, roller blades, roller skates, and stunt type bicycles upon public property
a. Stairs
b. Fountain Areas
c. Plazas
d. Any area under the care, custody and control of the city
i. Shall NOT include streets or sidewalks
What 2 things does the operator of a Pedicab need?
a. Hackney License
b. Valid Driver’s License
Parking in Marked Bike Lane
No driver shall stand or park any MV in a marked bike lane, EXCEPT:
a. When necessary to avoid conflict with other traffic or pedestrians;
b. In compliance with the lawful direction of a PO or official traffic sign; or
c. Unless authorized to do so under existing regulations (resi parking or parking meters)
Vehicles for Hire
Gypsy cab drivers that are not authorized by Hackney – this is the only violation that a police officer can arrest without a warning
Taxicab Licensed Outside the City of Boston ONLY Allowed to do 3 things
a. Drive though said city
b. Pick up passengers if called by phone
c. Pick up passengers if dispatched
