What must occur when a defendant proposes a settlement to a class action?
A
When a settlement is proposed to the court,
(1) notice of the proposal must be provided to all class members who would be bound by it. This allows members to object to and opt out of the settlement before the court approves it
(2) must be approved by the court to be valid. The court may approve such a proposal only after it holds a hearing and issues findings that the settlement is fair, reasonable, and adequate.
