Representative of Inventor and Ownership
Power of Attorney
Inventor (pro se), One of several inventors, or registered attorney/agent
List of USPTO customer numbers instead of individual names on POA (if names, 10 names max)
Revoking POA
Any time for any reason -
effective on the date received by PTO
Withdrawing from Representation
Must be by petition to the Director. Must certify (1) given reasonable notice to client, prior to the expiration of the reply period, of intent to withdraw, (2) delivered to client or another rep all papers and property to which client is entitled, and (3) notified client of any replies that may be due and the time frame within which the client must respond.
Filing Arguments
No longer required to read the argument, but you cannot file arguments you know to be wrong or papers whose contents are a mystery to you.
Substitute Statement
If inventor is dead, insane, or otherwise unavailable a substitute statement may be filed by someone else on the inventor’s behalf.
Death of Inventor and POA
Death terminates POA (unless power remains via a co-inventor). A new POA must be executed by heirs.
Compensation
May not acquire interest in litigation or proceeding but may contract for a reasonable contingent fee or take an interest in a patent or application as part of the fee.
